        "content": "<p>Businessman faces 14 years imprisonment<\/p>\n<p>JAKARTA (JP): A state prosecutor asked the North Jakarta<br>\nDistrict Court yesterday to sentence businessman Hasan, alias Eng<br>\nSan, to 14 years in jail for inducing other people to kill his<br>\nbusiness rival Nyo Beng Seng.<\/p>\n<p>Prosecutor Andhi Nirwanto said Eng San was guilty of violating<br>\narticle 55 of the Penal Code which carries a maximum 15 years<br>\njail term.<\/p>\n<p>&quot;The defendant deserves such a sentence since he organized the<br>\nmurder. He had also been convicted before for gambling.&quot;<\/p>\n<p>According to the prosecutor, Eng San also gave confusing<br>\ntestimony and hampered the trial by faking illness.<\/p>\n<p>Yesterday&apos;s session also featured the prosecutor and lawyers<br>\narguments. The session was scheduled to hear three witnesses<br>\nasked by Judge Bhaedowie but neither the prosecutor nor the<br>\ndefense lawyers were able to bring them to the stand.<\/p>\n<p>The prosecutor said he could not present witness Kiki Arianto<br>\nbecause he was not at his previous address in Bekasi.<\/p>\n<p>&quot;We have sent several summons but he is not there anymore. We<br>\nhave also searched his whereabouts but came up empty-handed,&quot;<br>\nAndhi said.<\/p>\n<p>The prosecutor asked the court to allow him to continue the<br>\ntrial with his concluding statement.<\/p>\n<p>The request was strongly objected by defense lawyers Soedjono<br>\nand Teguh Samudera because they could present their witnesses,<br>\nbut needed another week to prepare.<\/p>\n<p>&quot;My colleagues and I met with Hong Lie and A Gun in Hong Kong<br>\nlast week. Both of them agreed to testify in person, but A Gun<br>\nwill need one week to complete his visa, while Hong Lie still has<br>\nother business in the U.S,&quot; Soedjono said.<\/p>\n<p>Last week, Judge Bhaedowie asked the prosecutor and the<br>\ndefense lawyers to present witnesses, Kiki Arianto, A Gun, and<br>\nHong Lie in court because their written testimony was unclear and<br>\nthe court would hear them under cross-examination.<\/p>\n<p>According to the police, the three witnesses are wanted for<br>\ntheir involvement in the crime.<\/p>\n<p>Soedjono said they had pictures of Hong Lie and A Gun to prove<br>\ntheir meeting and a videotape of their willingness to testify in<br>\nperson.<\/p>\n<p>Soedjono asked the court to allow him to play the tape, but<br>\nthe prosecutor argued against this, saying neither he nor the<br>\ndefense lawyers could present their witnesses.<\/p>\n<p>&quot;Other proof is not relevant in today&apos;s hearing, so I ask the<br>\ncourt to continue with the session,&quot; Andhi said.<\/p>\n<p>The prosecutor&apos;s statement was protested by the lawyers.<\/p>\n<p>&quot;Compared to what we have done to present our witnesses, I<br>\nthink the prosecutor should have done much better since his<br>\nwitness lives in Bekasi, while we have had to go all the way to<br>\nHong Kong,&quot; Soedjono said.<\/p>\n<p>Judge Bhaedowie said that since the two parties had failed to<br>\npresent witnesses, the prosecutor could precede with the sentence<br>\nrequest.<\/p>\n<p>The decision was booed by onlookers who packed the room.<\/p>\n<p>Yesterday&apos;s session had been postponed three times due to the<br>\nlawyer&apos;s absence, the prosecutor was not ready to read his<br>\nsentence request and the defendant&apos;s absence because of sickness.<br>\n(12)<\/p>",
