Businessman faces 14 years imprisonment<\/p>\n
JAKARTA (JP): A state prosecutor asked the North Jakarta
\nDistrict Court yesterday to sentence businessman Hasan, alias Eng
\nSan, to 14 years in jail for inducing other people to kill his
\nbusiness rival Nyo Beng Seng.<\/p>\n
Prosecutor Andhi Nirwanto said Eng San was guilty of violating
\narticle 55 of the Penal Code which carries a maximum 15 years
\njail term.<\/p>\n
"The defendant deserves such a sentence since he organized the
\nmurder. He had also been convicted before for gambling."<\/p>\n
According to the prosecutor, Eng San also gave confusing
\ntestimony and hampered the trial by faking illness.<\/p>\n
Yesterday's session also featured the prosecutor and lawyers
\narguments. The session was scheduled to hear three witnesses
\nasked by Judge Bhaedowie but neither the prosecutor nor the
\ndefense lawyers were able to bring them to the stand.<\/p>\n
The prosecutor said he could not present witness Kiki Arianto
\nbecause he was not at his previous address in Bekasi.<\/p>\n
"We have sent several summons but he is not there anymore. We
\nhave also searched his whereabouts but came up empty-handed,"
\nAndhi said.<\/p>\n
The prosecutor asked the court to allow him to continue the
\ntrial with his concluding statement.<\/p>\n
The request was strongly objected by defense lawyers Soedjono
\nand Teguh Samudera because they could present their witnesses,
\nbut needed another week to prepare.<\/p>\n
"My colleagues and I met with Hong Lie and A Gun in Hong Kong
\nlast week. Both of them agreed to testify in person, but A Gun
\nwill need one week to complete his visa, while Hong Lie still has
\nother business in the U.S," Soedjono said.<\/p>\n
Last week, Judge Bhaedowie asked the prosecutor and the
\ndefense lawyers to present witnesses, Kiki Arianto, A Gun, and
\nHong Lie in court because their written testimony was unclear and
\nthe court would hear them under cross-examination.<\/p>\n
According to the police, the three witnesses are wanted for
\ntheir involvement in the crime.<\/p>\n
Soedjono said they had pictures of Hong Lie and A Gun to prove
\ntheir meeting and a videotape of their willingness to testify in
\nperson.<\/p>\n
Soedjono asked the court to allow him to play the tape, but
\nthe prosecutor argued against this, saying neither he nor the
\ndefense lawyers could present their witnesses.<\/p>\n
"Other proof is not relevant in today's hearing, so I ask the
\ncourt to continue with the session," Andhi said.<\/p>\n
The prosecutor's statement was protested by the lawyers.<\/p>\n
"Compared to what we have done to present our witnesses, I
\nthink the prosecutor should have done much better since his
\nwitness lives in Bekasi, while we have had to go all the way to
\nHong Kong," Soedjono said.<\/p>\n
Judge Bhaedowie said that since the two parties had failed to
\npresent witnesses, the prosecutor could precede with the sentence
\nrequest.<\/p>\n
The decision was booed by onlookers who packed the room.<\/p>\n
Yesterday's session had been postponed three times due to the
\nlawyer's absence, the prosecutor was not ready to read his
\nsentence request and the defendant's absence because of sickness.
