        "content": "<p>Building must be torn down: Court<\/p>\n<p>BOGOR (JP): The Supreme Court has ordered the immediate<br>\ndemolition of a three-story building on Jl. Baru-Kedungbadak in<br>\nTanah Sareal and upheld a Bogor resident's claim that it was<br>\nerected illegally.<\/p>\n<p>The head of Bogor District Court, Arsad Sanusi, said that<br>\nprivate developer PT Bangun Adigraha constructed the building,<br>\nwhich has a floor space of 20,000 square meters and is located on<br>\na 57,905-square-meter plot.<\/p>\n<p>The company leased the building to Mega M shopping center of<br>\nMatahari group, despite an ongoing dispute between the developer<br>\nand the landowner, Usnianingsih, he said Tuesday.<\/p>\n<p>Usnianingsih's court victory means that she has been deemed<br>\nthe legal owner of the land, he said.<\/p>\n<p>The developer has lodged several documents with the court to<br>\nreinforce its request for the demolition to be postponed.<\/p>\n<p>\"But the Supreme Court has learned that the documents are fake<br>\nand ordered the local court to enforce the order immediately.\"<\/p>\n<p>Bogor District Court will oversee the bulldozing of the<br>\nbuilding which would have cost billions of rupiah to build, he<br>\nsaid.<\/p>\n<p>\"But we're still looking for a win-win solution (for both<br>\nparties) and an appropriate use for the building.<\/p>\n<p>\"We are trying to find ways in which both parties could come<br>\nto an amicable agreement. The solution could vary, maybe the land<br>\nowner could buy the building, or the developer could purchase the<br>\nland.\"<\/p>\n<p>Arsad said the two parties met on Nov. 18 and would meet again<br>\non Dec. 8 to further discuss the fate of the disputed building<br>\nand the land.<\/p>\n<p>But it seems that Usnianingsih does not want the building on<br>\nher land.<\/p>\n<p>Her lawyer, Sofyan Syarif, admitted that Arsad had urged his<br>\nclient to resolve the matter peacefully but \"we want the Supreme<br>\nCourt's order to be executed soon\".<\/p>\n<p>Executives of PT Bangun Adigraha could not be reached for<br>\ncomment yesterday.<\/p>\n<p>A spokesman for Matahari, Rudy Sumampouw, refused to provide<br>\ndetails about the contracts.<\/p>\n<p>\"It's true that we're going to hire it but I have no authority<br>\nto disclose details of the contract because we have another<br>\nsection handling the matter,\" he said.
