        "content": "<p>Mataram (ANTARA) - Three legislators, namely Indra Jaya Usman, Hamdan\nKasim, and Muhammad Nashib Ikroman, remain defendants in the NTB DPRD\ngraft case despite being released from detention.<\/p>\n<p>\u201cThey remain defendants until there is a determination by the panel\nof judges,\u201d said the Spokesperson for the West Nusa Tenggara High\nProsecutor\u2019s Office (Kejati NTB), Harun Al Rasyid, in Mataram on\nThursday.<\/p>\n<p>He stated that his side respects the panel of judges\u2019 determination\ngranting the suspension of detention for the three defendants, as the\ndetention period until the first-instance court has expired before the\nverdict agenda.<\/p>\n<p>According to him, the determination by the panel of judges chaired by\nDewi Santini is in line with the provisions of the new Criminal\nProcedure Code (KUHAP), which limits the detention period for\ndefendants.<\/p>\n<p>Therefore, Harun conveyed that the prosecution, as the public\nprosecutor in this case, cannot force re-detention.<\/p>\n<p>He acknowledged that this situation poses a challenge for the\nprosecutors to continue the trial agenda while ensuring the presence of\nthe defendants before the panel of judges.<\/p>\n<p>\u201cSo, here (in the trial), we still have the burden of proof. This\ncase is still ongoing, and the judge has also emphasised that the trial\nwill continue. Clearly, our evidence is serious; we have brought this\ncase to court,\u201d he said.<\/p>\n<p>In the last trial agenda on Wednesday (13\/5), the panel of judges had\nconcluded the examination of witnesses before granting the suspension of\ndetention.<\/p>\n<p>Starting from the Wednesday agenda next week (20\/5), the public\nprosecutor will present several experts to strengthen the alleged\ngratification as per the indictment.<\/p>\n<p>\u201cIndeed, this is already at the end of the trial, but we are still\ngathering facts on the involvement of others; we will wait until the end\n(of the trial),\u201d he said.<\/p>\n<p>Regarding the issue of the NTB High Prosecutor\u2019s Office receiving\n\u201cfacilitation money\u201d worth hundreds of millions from the bribed\nlegislators, Harun firmly stated that it is untrue.<\/p>\n<p>\u201cIndeed, money was given, but that is deposit money that we have\nentered into the Other Government Account (RPL). So, it\u2019s not personal\nmoney; there is no such thing (as facilitation money),\u201d Harun said.<\/p>\n<p>In the last trial on Wednesday (13\/5), the panel of judges asked the\nthree defendants to remain cooperative despite being free from\ndetention.<\/p>\n<p>\u201cIf you abscond or flee, we will still conduct the trial \u2018in\nabsentia\u2019. We can still proceed with the trial \u2018in absentia\u2019 without\nyour presence if you do not attend,\u201d he said.<\/p>\n<p>The three defendants have been in detention since the investigation\nstage by the prosecutors. The first to be detained were two individuals,\nIndra Jaya Usman and Muhammad Nashib Ikroman, since 20 November\n2026.<\/p>\n<p>Meanwhile, defendant Hamdan Kasim began serving detention during the\nprosecutorial investigation since 24 November 2026.<\/p>",
