BPK Still Cannot Audit Data of Taxpayers

TEMPO Interactive, Jakarta: The Directorate General of Taxes has refused the request of the Supreme Audit Agency (BPK) to provide access to data of taxpayers.<\/p>\n
\u201cWe will certainly not permit them to access the archives of taxpayers,\u201d said Director General of Taxes Darmin Nasution last week in Jakarta.<\/p>\n
According to Darmin, people pay tax voluntarily.<\/p>\n
If many parties are able to access data relating to taxes, revenues and companies' secrets, then people will no longer pay taxes.<\/p>\n
\u201cIt will be difficult,\u201d he said.<\/p>\n
Law Number 16\/2000 concerning General Provisions and Guidelines on Taxation says that taxpayers' information cannot be accessed by other parties, including the BPK, without permission from the Finance Minister.<\/p>\n
He had confirmed that the BPK could investigate a taxpayer if he or she became a suspect.<\/p>\n
\u201cIf one is not a suspect, then access is not allowed,\u201d he said.<\/p>\n
Darmin went on to say that the BPK may also audit the Directorate General of Taxes in order to know the fairness of tax revenues.<\/p>\n
The reason for this was that the state auditor did have the right to audit taxes.<\/p>\n
\u201cYou don't have to access someone's account when auditing a bank. Nor does one need to access taxpayers' data if you want to audit taxes,\u201d he said.<\/p>\n
\u201cIf they (BPK) want to ask for data of tax revenues per sector or per industry, we can give this to them. But we will not give them personal data of taxpayers,\u201d he added.<\/p>\n
