Balikpapan (ANTARA) - The Borneo Orangutan Survival Foundation (BOSF)\nhas reaffirmed its commitment to defending the land rights of the\nSamboja Lestari conservation area in Kutai Kartanegara Regency, East\nKalimantan, against all forms of encroachment and illegal transfer of\nrights.<\/p>\n
BOSF Chief Executive Officer (CEO) Aldrianto Priadjati expressed his\nappreciation for the conclusion of all legal processes regarding the\nland encroachment case in Amborawang Darat Village, Samboja District,\nfollowing the execution of convict Marten Bauk to the Tenggarakan\nCorrectional Institution (Lapas).<\/p>\n
\u201cThe Supreme Court\u2019s cassation decision proves legally that the land\nwhich is the object of the case belongs to the BOS Foundation. The\nconvict was found guilty and sentenced to imprisonment,\u201d Aldrianto\nstated in Balikpapan on Saturday.<\/p>\n
The case has reached permanent legal force (inkracht) after\nundergoing judicial processes since 2022.<\/p>\n
The convict was proven to have violated Article 385, paragraph (1) of\nthe Criminal Code regarding land encroachment and the unlawful seizure\nof land rights.<\/p>\n
Following the verdict, the Kutai Kartanegara District Attorney\u2019s\nOffice has carried out the detention execution of the convict in\naccordance with applicable legal provisions.<\/p>\n
Aldrianto recounted that the BOS Foundation field team discovered\nsuspected transactions involving the unauthorised transfer of rights to\nthe Samboja Lestari land on 16 March 2022.<\/p>\n
BOSF subsequently reported the incident to the Samboja Police on 7\nApril 2022. The case progressed through the Tenggarong District Court,\nthe Samarinda High Court, and finally to the Cassation level at the\nSupreme Court.<\/p>\n
This legal certainty, Aldrianto continued, serves as an important\nreminder that all of BOSF\u2019s conservation land management activities are\nbased on valid legal documents.<\/p>\n
He urged the public to always verify the status, legality, and land\nrights before conducting transactions to avoid potential legal\nviolations in the future.<\/p>\n
