        "content": "<p>Jakarta (ANTARA) - The Head of the National Narcotics Agency (BNN),\nSuyudi Ario Seto, has proposed that the mechanism for wiretapping in\nefforts to combat narcotics cases should be permissible from the\ninvestigation stage, which needs to be regulated in the Narcotics and\nPsychotropics Bill.<\/p>\n<p>He stated that the new Criminal Procedure Code (KUHAP) has restricted\nwiretapping authority solely to the inquiry stage. However, he believes\nthat such authority is also crucial from the investigation phase and is\nan inseparable part of fulfilling the elements of criminal offences.<\/p>\n<p>\u201cWiretapping authority granted from the early stage could serve as\ninitial material or screening to determine legal status and subsequent\nlegal actions,\u201d Suyudi said during a meeting with Commission III of the\nHouse of Representatives (DPR RI) at the parliamentary complex in\nJakarta on Tuesday.<\/p>\n<p>Through wiretapping at the investigation stage, according to him, the\nlegal status of subjects can be confirmed\u2014whether they are merely users\nor involved as part of narcotics distribution networks.<\/p>\n<p>In addition, he explained that the characteristics of narcotics\ncrimes involve operating very silently. Therefore, wiretapping is needed\nas a special investigation technique, which is essentially covert or\nundercover intelligence activity.<\/p>\n<p>\u201cThe purpose is not to directly obtain evidence for prosecution, but\npurely to gather preliminary evidence and map criminal networks that are\noften invisible on the surface,\u201d he said.<\/p>\n<p>According to him, the proposal aligns with the strategic views of the\nNational Police (Polri) and has been supported by the new KUHAP, which\nprovides room for the wiretapping mechanism to be regulated through\nseparate rules or lex specialis, via the Narcotics and Psychotropics\nBill.<\/p>\n<p>\u201cIn implementing the evidence provisions under Article 86 of Law\nNo.\u00a035 of 2009, this has also been concretised as the result of\nwiretapping, so the Narcotics Bill must explicitly regulate\nwiretapping,\u201d he stated.<\/p>",
