The Coordinating Minister for Law, Human Rights, Immigration, and\nCorrectional Affairs, Yusril Ihza Mahendra, has set a target to complete\nthe final draft of the Bill on the Transfer of Prisoners between\nCountries within this year.<\/p>\n
While presiding over a meeting with the Minister of Immigration and\nCorrectional Affairs, Agus Andrianto, and other officials in Jakarta on\nWednesday (16\/9), he urged the acceleration of the Bill\u2019s preparation to\nserve as a legal foundation that provides certainty in the execution of\ncross-border prisoner transfers.<\/p>\n
\u201cOur target is that, if possible, it must be finished this year,\u201d\nYusril stated.<\/p>\n
He emphasised that the drafting of the regulation must be conducted\neffectively, taking into account the prisoner transfer practices that\nIndonesia has historically implemented. He noted that the established\nregulations must provide legal certainty without creating mechanisms\nthat complicate the transfer and rehabilitation processes.<\/p>\n
\u201cWe have it easy because these practices are already being\nimplemented in the field without obstacles. We should continue with what\nworks rather than creating new rules that might make things difficult\nlater,\u201d he said.<\/p>\n
Yusril explained that a crucial element to be clarified in the Bill\nis the authority and responsibility of the receiving state once a\nprisoner has been transferred. This issue has been a key focus in the\ndiscussions regarding the draft agreement for prisoner transfers with\nMalaysia. The Coordinating Minister argued that once the transfer\nprocess is complete, the responsibility for the prisoner\u2019s\nrehabilitation should lie with the receiving country.<\/p>\n
Consequently, authority regarding rehabilitation, including the\ngranting of remissions or pardon mechanisms such as clemency, could be\nexecuted based on the legal provisions of the country receiving the\nprisoner. \u201cTherefore, we ourselves will make the decisions regarding the\nrehabilitation of these prisoners. Once the responsibility for\nrehabilitation is handed over, it becomes the responsibility of the\nrelevant government, no longer Indonesia,\u201d Yusril added.<\/p>\n
Regarding cooperation with Malaysia, Yusril noted that discussions on\nthe draft agreement are progressing and nearing the final stage. He\nstated that negotiations with Malaysia should continue while awaiting\nthe completion of the Bill. \u201cIf this Bill is not yet finished, it is\nbetter that we continue these negotiations with Malaysia. Once the Bill\nis completed, I will hand it back to the Minister of Immigration and\nCorrectional Affairs,\u201d the Coordinating Minister remarked.<\/p>\n
During the meeting, Minister of Immigration and Correctional Affairs\nAgus Andrianto stated that his ministry has received instructions to act\nas the initiator of the Bill on the Transfer of Prisoners between\nCountries. He mentioned that the Ministry of Immigration and\nCorrectional Affairs has conducted internal discussions and will soon\nform an inter-ministerial committee to accelerate the drafting\nprocess.<\/p>\n
\u201cIn essence, we are ready to immediately follow up on the\ninstructions from the Minister of State Secretary and the Coordinating\nMinister; hopefully, the team we assemble can work quickly. We also\nrealise that this is an extremely necessary piece of legislation,\u201d said\nAgus.<\/p>\n
Agus added that the regulation is expected to simplify the transfer\nprocess for Indonesian citizens from other countries to Indonesia and\nvice versa, through a clear and non-bureaucratic mechanism.<\/p>\n
The meeting focused on accelerating the preparation of the Bill and\nreviewing the progress of prisoner transfer cooperation between\nIndonesia and Malaysia. This initiative is part of the government\u2019s\nefforts to strengthen the legal framework for prisoner transfers with\nother nations.
