Bill on correctional system<\/p>\n
JAKARTA (JP): The government yesterday presented to the House
\nof Representatives a bill on the correctional system, seeking to
\nreaffirm the principle of imprisonment as a means of
\nrehabilitation rather than punishment.<\/p>\n
Minister of Justice Oetojo Oesman, on behalf of the
\ngovernment, said during the first deliberation of the bill at a
\nplenary session of the House that it was high time the principle
\nof rehabilitation, first introduced in 1964, was incorporated
\ninto the national legislation<\/p>\n
After more than 30 years of applying the principle, subjecting
\nit to tests and reviews, the government prepared the draft law to
\nprovide a strong legal foundation to the correctional system in
\nIndonesia, Oetojo said.<\/p>\n
The principle of rehabilitation applies to both convicts and
\ndelinquent juveniles who are put under state care, he said as
\nreported by Antara.<\/p>\n
The bill stipulates that convicts and juvenile offenders are
\nentitled to counseling and guidance while in correctional
\ninstitutions, so that they can return to society as responsible
\ncitizens useful to the country, he said.<\/p>\n
According to the bill, imprisonment should not be seen as an
\nact of vengeance by the state.<\/p>\n
The principle, however, does not seem to apply to offenses
\nthat carry the death penalty, such as subversion, drug
\ntrafficking and some types of murder.<\/p>\n
The bill will replace some of the laws and regulations still
\nin existence which Indonesia inherited from the Dutch colonial
\nadministration and which need replacing. They include regulations
\non imprisonment, on parole, on enforced education and conditional
