BATAN cooperatives to sue developer<\/p>\n
JAKARTA (JP): Workers cooperatives of the National Atomic
\nEnergy Agency (BATAN) will sue private developer, PT Roma Permai
\nAbdina, for an alleged swindle involving more than Rp 1 billion,
\na lawyer said on Wednesday.<\/p>\n
Lawyer Firmansyah Arifin of the Jakarta Legal Aid Institute
\nwho met with cooperative executives on the same day, said his
\nclient will also report the housing developer to the police.<\/p>\n
\"Our client repeatedly asked the developer to return the
\ndown payment, but they have not received a satisfactory response.
\nSo the cooperatives decided to take legal action,\" Firmansyah
\nsaid.<\/p>\n
He said the cooperatives would ask the court to seize 5
\nhectares in Curug village, Bogor, as well as other assets
\nbelonging to the developer.<\/p>\n
\"We will also report the developer's management to the
\npolice.\"<\/p>\n
He said the cooperatives signed an agreement with the
\ndeveloper in September, 1994, to build 350 houses of the 21-
\nsquare-meter type in Curug village.<\/p>\n
In the agreement, the cooperatives were responsible for
\nprocessing the permits for land appropriation in the village,
\nwhile the developer was to provide the funds, he said.<\/p>\n
Without providing details on the permit processing, Firmansyah
\nsaid that the cooperatives had paid a down payment to the
\ndeveloper to build the houses.<\/p>\n
Construction on the project was expected to be completed in
\n1997.<\/p>\n
\"But until now, not a single house has been built by the
\nfirm,\" he said.<\/p>\n
Company representatives could not be reached for comment on
\nWednesday.<\/p>\n
According to Firmansyah, the cooperatives often asked the
\ndeveloper to return the down payment, but the firm continued to
\ndelay the payment.<\/p>\n
He said the developer paid the cooperative Rp 150 million
\nfollowing a meeting in the State Minister of Public Housing's
\noffice last year.<\/p>\n
\"But since then the developer has reneged on the remainder,
\nwhich totals more than Rp 1 billion.\"<\/p>\n
He said 350 employees of BATAN had paid at least Rp 4 million
\neach for the down payment.<\/p>\n
\"They only hope that their money will be refunded,\" he added.
