Banggai Regent Amiruddin Tamoreka has for the second time failed to\nappear before the Palu State Administrative Court (PTUN) in connection\nwith the execution of a ruling concerning the dismissal of six village\nheads.<\/p>\n
Muhammad Takdir Al Mubaraq, legal counsel for the six village heads,\nsaid in Palu on Monday that the Banggai Regent had previously also\nfailed to attend a PTUN Palu summons on 20 August 2026.<\/p>\n
PTUN Palu has now rescheduled the summons for the Banggai Regent for\nMonday (7\/9).<\/p>\n
\u201cThe Banggai Regent has been summoned twice to attend the PTUN Palu\nexecution hearing but he has not appeared. This certainly raises serious\nquestions,\u201d Takdir said.<\/p>\n
According to him, as a regional head, the Banggai Regent should set\nan example in respecting the legal process and judicial\ninstitutions.<\/p>\n
\u201cWe hope there will be a clear explanation and that the legal process\ncontinues in accordance with the provisions,\u201d he said.<\/p>\n
Takdir said the summons on 7 September 2026 would be the next\nopportunity for the defendant to attend the process of implementing the\nruling.<\/p>\n
According to him, if the Banggai Regent again fails to attend the\nnext summons, PTUN Palu may proceed to the next stage in accordance with\nthe provisions on the execution of rulings.<\/p>\n
\u201cThere will be a third summons to the defendant, the Banggai Regent,\nwhich will also serve as the final proper summons. If he still does not\nappear, the Chief Judge of PTUN Palu will issue a warning letter and\ncontinue the process to the execution determination stage after 21\nworking days,\u201d he said.<\/p>\n
Zainudin Saluki, Head of the Legal Bureau of the Banggai Regency\nRegional Secretariat, when contacted, had not yet provided a response\nregarding the Banggai Regent\u2019s absence.<\/p>\n
The case began when the Banggai Regent dismissed six village heads on\n18 June 2025 because they were deemed not neutral in the repeat vote\n(PSU) of the 2024 Banggai Regent Election.<\/p>\n
The six village heads are Sudarsono, Head of Sentral Sari Village;\nRuhyana, Head of Mansahang Village; Manippi, Head of Jaya Kencana\nVillage; and Mustofa, Head of Tirta Sari Village in Toili District.<\/p>\n
The other two are Indri Yani Madalombang, Head of Gonohop Village,\nand Fenny Sangkaning Rahayu, Head of Simpang Dua Village in Simpang Raya\nDistrict.<\/p>\n
The six village heads then challenged the dismissal decision at PTUN\nPalu in cases Number 21\/G\/2025\/PTUN.PL through 26\/G\/2025\/PTUN.PL.<\/p>\n
PTUN Palu granted their lawsuit by annulling the dismissal decision\nand ordering the Banggai Regent to revoke the decision and restore the\npositions of the village heads.<\/p>\n
The Banggai Regent then filed an appeal to the Makassar State\nAdministrative High Court, but the appeal was rejected and the PTUN Palu\nruling was upheld.<\/p>\n
