The Attorney General\u2019s Office (AGO) will continue to use calculations\nfrom the Financial and Development Supervisory Agency (BPKP) to\ndetermine state financial losses.<\/p>\n
This was stated by the Director of Investigations of the Deputy\nAttorney General for Special Crimes, Syarief Sulaeman Nahdi, in response\nto the Constitutional Court (MK) ruling that the Audit Board of\nIndonesia (BPK) is the state institution authorised to conduct audits of\nstate financial losses.<\/p>\n
Syarief argued that the AGO has its own studies regarding the use of\nBPKP calculations as the basis for state financial losses in corruption\ncases.<\/p>\n
\u201cRegarding the MK\u2019s ruling, we will address it separately. We have\nour own studies, so for now, we are still using BPKP to calculate state\nfinancial losses,\u201d he told reporters on Friday (10\/4).<\/p>\n
He added that cooperation with BPKP is also ongoing for the latest\ncase being handled, namely the alleged corruption in the procurement of\ncrude oil by Pertamina Energy Trading Limited (Petral) for the period\n2008-2015.<\/p>\n
\u201cFor the amount of state financial losses, we are currently\ncalculating it together with our colleagues at BPKP,\u201d he explained.<\/p>\n
He described that in this case, PT Pertamina suffered losses because\nit had to pay higher costs for fuel procurement than it should have.<\/p>\n
\u201cWe will announce the amount of state financial losses or those\nclaimed on behalf of PT Pertamina. It will be announced; the calculation\nprocess is ongoing. We are not yet ready to provide the figure, but it\nis being calculated,\u201d he stated.<\/p>\n
Previously, the MK stated that BPK is the state institution\nauthorised to conduct audits of state financial losses.<\/p>\n
This view is contained in the decision of case number\n28\/PUU-XXIV\/2026, decided on Monday, 9 February 2026.<\/p>\n
This decision was made by nine constitutional judges: Suhartoyo as\nchair and member, Saldi Isra, Daniel Yusmic P Foekh, M Guntur Hamzah,\nAnwar Usman, Enny Nurbaningsih, Ridwan Mansyur, Arsul Sani, and Adies\nKadir, each as members.<\/p>\n
The petitioners in the case were two students named Bernita Matondang\nand Vendy Setiawan, who challenged the material of Articles 603 and 604\nof the Criminal Code (KUHP).<\/p>\n
