        "content": "<p>Jakarta \u2014 Indonesia\u2019s Attorney General\u2019s Office (Kejagung) has issued\na response regarding the acquittal verdict against Delpedro Marhaen,\nExecutive Director of Lokataru Foundation, and others in connection with\ncharges of allegedly inciting violence during the August 2025\ndemonstrations.<\/p>\n<p>Anang Supriatna, Chief of the Attorney General\u2019s Legal Information\nCentre (Kapuspenkum), stated in Jakarta on Friday that prosecutors are\nstill determining their position on whether to file a cassation\nappeal.<\/p>\n<p>\u201cClearly, the defendants have been acquitted, but the case was\nprocessed using the old penal code at the time. We shall await the\nprosecutors\u2019 position in due course,\u201d he said.<\/p>\n<p>Previously, Delpedro Marhaen, Executive Director of Lokataru\nFoundation, and three others were acquitted of charges related to\nallegedly inciting violence during the chaotic August 2025\ndemonstrations, in a verdict delivered by the panel of judges at Jakarta\nCentral District Court.<\/p>\n<p>Alongside Delpedro, three other defendants acquitted by the court\nincluded Lokataru staff member Muzaffar Salim, administrator of Gejayan\nMemanggil Syahdan Husein, and administrator of Aliansi Mahasiswa\nPenggugat Khariq Anhar.<\/p>\n<p>\u201cWe declare the defendants not proven guilty of the criminal offence\nas charged in the prosecution\u2019s alternative charges two, three and\nfour,\u201d said presiding judge Harika Nova Yeri.<\/p>\n<p>The presiding judge stated that during proceedings, the prosecutors\nfailed to present evidence demonstrating any attempt at manipulation,\nfabrication or falsification of facts by the defendants.<\/p>\n<p>In particular, the judge continued, regarding social media posts\nconcerning the circumstances and cause of death of ride-hailing\nmotorcyclist driver Affan Kurniawan.<\/p>\n<p>The panel of judges found that such posts represented a response of\nanger and human solidarity by human rights activists regarding the\nincident that befell Affan, rather than an incitement to riot.<\/p>\n<p>\u201cSuch posts represented symbolic expression as a form of freedom of\nexpression in response to dissatisfaction with the incident that\naffected Affan Kurniawan,\u201d the presiding judge stated.<\/p>\n<p>Previously, the four defendants faced charges carrying a sentence of\ntwo years imprisonment, as prosecutors believed they had participated in\npublic incitement through speech or writing encouraging others to commit\ncriminal offences or inciting resistance to lawful authority through\nviolence.<\/p>",
