        "content": "<p>JAKARTA, KOMPAS.com - The Attorney General\u2019s Office (Kejagung) has\naffirmed that the calculation of state financial losses in corruption\ncriminal cases can be carried out not only by the Supreme Audit Agency\n(BPK), but also by other authorised institutions, including the\nFinancial and Development Supervisory Agency (BPKP) or appointed public\naccountants.<\/p>\n<p>This affirmation was conveyed by Kejagung through a Circular (SE)\nfollowing the emergence of various interpretations of Constitutional\nCourt (MK) Decision No.\u00a028\/PUU-XXIV\/2026 regarding the parties\nauthorised to determine state losses in corruption cases.<\/p>\n<p>Head of the Legal Information Centre (Kapuspenkum) of Kejagung, Anang\nSupriatna, stated that his institution has issued the SE to all regions\nso that the MK decision is not read partially.<\/p>\n<p>\u201cWe have already issued a circular to the regions for guidance, but\nnot everyone can. That MK decision should be read in full, not\npartially,\u201d said Anang at the Kejagung Building, Jakarta, on Tuesday\n(12\/5\/2026).<\/p>\n<p>\u201cThere is in the MK considerations not strictly like that. Just read\nthe MK decision in full, friends, don\u2019t read it on TikTok which is just\na glimpse, but read the full MK decision. There it is, it can still use\n(other institutions besides BPK),\u201d Anang added.<\/p>\n<p>When asked whether audits of state losses from BPKP and other\ninstitutions can still be used in corruption cases, Anang confirmed that\nit is still permitted.<\/p>\n<p>\u201cIt can still,\u201d he said.<\/p>\n<p>Kejagung\u2019s official stance is contained in a letter numbered\nB-1391\/F\/Fjp\/04\/2026 dated 20 April 2026, signed by Deputy Attorney\nGeneral for Special Crimes Febrie Adriansyah.<\/p>\n<p>The letter was sent to all Chief State Prosecutors (Kajati) in\nIndonesia as a guideline for handling corruption cases following the\nissuance of the MK decision.<\/p>\n<p>The Prosecutor\u2019s Office also assesses that the decision cannot be\ninterpreted to mean that only BPK is authorised to state state\nlosses.<\/p>\n<p>According to the Prosecutor\u2019s Office, the MK\u2019s consideration which\nstates that BPK has the authority to assess and determine state losses\nis not intended to create a new norm that BPK is the only institution\nauthorised.<\/p>\n<p>\u201cThe decision is not a decision that has binding legal\nforce\/accepted, so the existing interpretations do not have legal\nforce,\u201d the letter states.<\/p>\n<p>Kejagung emphasises that law enforcement officials continue to be\nguided by several previous MK decisions, namely MK Decision\nNo.\u00a0142\/PUU-XXII\/2024, MK Decision No.\u00a025\/PUU-XIV\/2016, and MK Decision\nNo.\u00a031\/PUU-X\/2012.<\/p>",
