JAKARTA - The sentence for Mulyatsyah, a former official from the\nMinistry of Education, Culture, Research, and Technology\n(Kemdikbudristek) during Nadiem Makarim\u2019s tenure, was lighter than the\nprosecutors\u2019 demand because Mulyatsyah had previously received an\nanti-corruption award.<\/p>\n
\u201cThe defendant has served as a civil servant for decades with a good\ntrack record and once received a regional corruption-free award in\n2019,\u201d stated the Chief Judge, Purwanto S Abdullah, during the trial at\nthe Central Jakarta Corruption Court, on Thursday (30\/4\/2026).<\/p>\n
Mulyatsyah was sentenced to 4.5 years because the judges considered\nthat he had never been convicted before, was cooperative during the\ntrial process, and Rp 500 million had been seized to be counted as\nreplacement payment.<\/p>\n
However, the panel also considered several aggravating factors.<\/p>\n
The defendant\u2019s actions were deemed not to support the\nanti-corruption, collusion, and nepotism eradication programme, and\ncaused significant losses to the state.<\/p>\n
\u201cThe defendant\u2019s actions were carried out in the education sector,\nwhich directly impacts the quality of Indonesian children\u2019s education,\u201d\nhe explained.<\/p>\n
In its verdict, the panel of judges stated that Mulyatsyah was not\nproven guilty on the primary charge but was found guilty on the\nsubsidiary charge, namely committing corruption jointly.<\/p>\n
\u201cImposing a prison sentence on the defendant of 4 years and 6 months\nand a fine of Rp 500 million,\u201d said the judge.<\/p>\n
If the fine is not paid, it will be replaced with imprisonment for\n120 days. The panel also imposed an additional penalty of an obligation\nto pay replacement money of Rp 2.28 billion.<\/p>\n
This amount has been reduced by money seized from several parties,\nnamely Jumeri, Hamid Muhammad, and Sutanto, totalling Rp 725\nmillion.<\/p>\n
If the replacement money is not paid within one month after the\ndecision gains legal force, the defendant\u2019s assets may be seized and\nauctioned by the prosecutor.<\/p>\n
If insufficient, it will be replaced with imprisonment for two\nyears.<\/p>\n
The panel of judges also determined that the detention period already\nserved by the defendant is fully deducted from the imposed sentence and\nordered the defendant to remain detained.<\/p>\n
For evidence in the form of documents, some are designated for use in\nanother case in the name of the defendant Nadiem Anwar Makarim. In\naddition, the defendant is burdened with paying court costs of Rp\n5,000.<\/p>\n
