The advocacy team for Democracy visited Bareskrim Polri to report the\nacid attack on KontraS activist Andrie Yunus on Wednesday (8\/4). The\nreport urges the investigation of the case through the general courts\nusing charges of premeditated attempted murder and terrorism\noffences.<\/p>\n
This legal action is in response to the prior handover of evidence by\nPolda Metro Jaya to Puspom TNI. The advocacy team asserts that the\nvictim\u2019s right to report to the general courts must be accommodated by\nthe police.<\/p>\n
Representative of the Advocacy Team and KontraS Coordinator, Dimas\nBagus Arya, explained that the report refers to Article 459 of the\nCriminal Code. \u201cThe report involves Article 459 of the Criminal Code\nregarding premeditated attempted murder,\u201d Dimas stated.<\/p>\n
In addition to the premeditated murder charge, the legal team has\nincluded the construction of terrorism offences. Dimas noted that this\nis a follow-up to President Prabowo Subianto\u2019s earlier statement\ncondemning the attack on Andrie as an act of terror.<\/p>\n
\u201cAnd in response to what Mr Prabowo said that the action is part of\nterrorism, we are also using the construction of terrorism criminal\ncharges,\u201d he emphasised.<\/p>\n
Dimas added that the core of this reporting is to ensure that the\nacid attack case is processed through a Type B report at Mabes Polri so\nthat its handling is more transparent and can be widely monitored by the\npublic.<\/p>\n
Associate Lawyer at AMAR Law Firm & Public Interest Law Office,\nAirlangga Julio, revealed that based on the legal team\u2019s identification,\nthere are at least 16 individuals suspected of being involved in the\naction.<\/p>\n
He considers the perpetrators as civilians because there is no\nofficial information regarding their status.<\/p>\n
\u201cThe 16 perpetrators are, in our minds, civilians to date, because\nthere is no clear information from Puspom TNI or Polda Metro Jaya\nregarding the status of those perpetrators,\u201d Airlangga said.<\/p>\n
He confirmed that the report specifically includes charges of\npremeditated attempted murder juncto Article 17 and Article 20 of the\nCriminal Code, as well as terrorism charges. \u201cHere, we specifically want\nto report the terrorism offence to Bareskrim Mabes Polri,\u201d he\nclarified.<\/p>\n
Public lawyer at LBH Jakarta, Daniel Winarta, stated that the right\nof citizens to report is strictly regulated in the Perkapolri on human\nrights standards and Perkaba Reskrim.<\/p>\n
