Mataram (ANTARA) - Syamsul Hidayat, a criminal law academic at the\nUniversity of Matroll, has highlighted the handling of the illegal\nmining case in Sekotong, West Lombok, which has yet to enter stage two\ndespite the case file for one suspect being declared complete\n(P-21).<\/p>\n
\u201cThe commitment of law enforcement to eradicate illegal mining is\nwhat needs to be questioned,\u201d said Syamsul when asked for a legal\nopinion regarding the return of the Notice of Commencement of\nInvestigation (SPDP) for the Sekotong illegal mining case in Mataram on\nTuesday.<\/p>\n
The lecturer from the Faculty of Law, Social and Political Sciences\n(FHISIP) at the University of Mataram stated that illegal mining has\nbecome a government concern due to its widespread environmental\nimpact.<\/p>\n
\u201cConsider the impact: there is water pollution caused by the use of\ndangerous chemicals that are unmonitored because the activities are\nillegal. Not to mention the potential for disasters, such as floods and\nlandslides; the impact is extensive,\u201d he said.<\/p>\n
Therefore, Syamsul urged law enforcement agencies to strengthen\nenforcement against illegal mining activities.<\/p>\n
However, Syamsul questioned the return of the SPDP when the case file\nhad already been declared complete or P-21.<\/p>\n
\u201cThere is no such thing as returning an SPDP once it has reached\nP-21,\u201d he stated.<\/p>\n
The Mataram District Attorney\u2019s Office previously returned the SPDP\nfor suspect Faerozzabadi, also known as Eros, dated 18 July 2026, after\npolice investigators had not yet handed over the suspect and evidence or\nproceeded to stage two.<\/p>\n
The case file for Eros had been declared complete (P-21) by the\nexamining prosecutor since 15 April 2026.<\/p>\n
According to him, once the file is declared complete, there should be\nno further instructions requiring coordination between the examining\nprosecutor and the investigators.<\/p>\n
\u201cTherefore, there is no longer a term for returning an SPDP,\u201d he\nsaid.<\/p>\n
Syamsul argued that the prosecutor\u2019s office, as the controller of the\ncase, should be more active in pushing investigators to complete the\nprocess of handing over suspects and evidence.<\/p>\n
\u201cIn theory, the prosecution acts as the case controller and must\nactively encourage investigators. There is a line of coordination where\nthe prosecution can demand why the case has not reached stage two,\u201d he\nadded.<\/p>\n
Syamsul maintained that the termination of a case must be based on\nlegal grounds, such as the event not being a criminal offence, the death\nof the suspect, the statute of limitations, \u2018ne bis in idem\u2019, or the\nwithdrawal of a complaint for certain offences that are\ncomplaint-based.<\/p>\n
\u201cSo, if none of those criteria apply, the investigation must\ncontinue,\u201d he said.<\/p>\n
No Update Received<\/p>\n
Spokesperson for the Mataram District Attorney\u2019s Office, Ida Made Oka\nWijaya, stated that they have not yet received any developments from the\nWest Lombok Police investigators following the return of the SPDP.<\/p>\n
He noted that the prosecution cannot intervene with investigators to\nforce the immediate execution of stage two.<\/p>\n
The West Lombok Police Chief, AKBP Mellysa Amalia, when confirmed via\ntelephone and WhatsApp, has not yet responded regarding the reasons for\nthe delay in stage two.<\/p>\n
