The government and authorities are being urged to promptly provide a\ntransparent explanation regarding the main actors and directors behind\nthe acid attack case on KontraS Vice Coordinator Andrie Yunus. This was\nstated by political science academic from the National University of\nJakarta, Firdaus Syam. According to Firdaus, there is no justification\nfor state organs to carry out brutal and cruel actions against their\ncitizens.<\/p>\n
\u201cThe government must provide an open and transparent explanation to\nthe public, not only regarding the act of violence but also who the\nactors are and who the directors are; that must be revealed,\u201d Firdaus\nsaid during a public discussion organised by the Central Board of the\nIndonesia Youth Congress (DPP IYC) titled \u2018Strategic Relations of the\nMinistry of Defence and BAIS TNI in the Design of National Intelligence:\nLines of Coordination, Institutionality, and Human Rights Protection in\nIndonesia\u2019 in Jakarta on Thursday (9\/4).<\/p>\n
Firdaus stated that the resignation of the Head of the Strategic\nIntelligence Agency (Kabais), held by Lieutenant General TNI Yudi\nAbrimantyo, as a result of the Andrie Yunus case is not enough. He said\nthat this resignation is something that is certain or must be done as\nmoral, administrative, and institutional accountability.<\/p>\n
\u201cHowever, the legal aspects related to serious human rights\nviolations must be addressed,\u201d he emphasised.<\/p>\n
Firdaus also stressed that the duty of the TNI, from the highest to\nthe lowest structures, is for military defence, to be professional\nsoldiers. Amid Indonesia\u2019s increasingly challenging security and defence\nissues in the future.<\/p>\n
\u201cIn the future, there must be changes in structure and culture within\nthe Indonesian military. Structure means the military must not enter the\nrealm of civilian administration and business. They must not be\ninvolved; the military must focus, concentrate, and function as an\ninstitution that maintains and safeguards defence equipment and the\nsovereignty of the Unitary State of the Republic of Indonesia,\u201d he\nexplained.<\/p>\n
On that occasion, Director of the Indonesia Madani Circle Ray\nRangkuti deemed it illogical for the acid attack case on Andrie Yunus to\nbe tried in a military court. This is because the criminal act committed\nby TNI soldiers constitutes a general criminal offence with a civilian\nvictim.<\/p>\n
\u201cBut if there is a military member, a soldier, who disturbs his\nneighbour, should it be tried in a military court? That\u2019s not logical,\u201d\nsaid Ray.<\/p>\n
Ray acknowledged that all countries have military courts. However,\nmilitary courts deal with military crimes, such as treason, desertion,\nor leaking state secrets related to defence. Generally, he said,\nmilitary courts are closed unless declared open by the judge.<\/p>\n
\u201cFor example, treason, for example, desertion. For example, what\nelse, for example, leaking secrets related to defence. Yes, the trial\ncannot be in a general court. That is in a special court, called a\nmilitary court. Well, if that\u2019s the case, it\u2019s very reasonable. So\nmilitary courts can only be implemented for crimes related to the\nmilitary,\u201d Ray explained.<\/p>\n
Therefore, Ray said, the TNI Commander must immediately instruct his\nranks to have the Andrie Yunus case tried in a general court, not a\nmilitary court. According to Ray, this is important to restore public\ntrust in the TNI institution, which has been declining lately due to\nallegations of violence involving TNI soldiers and the TNI\u2019s excessive\ninvolvement in civilian realms such as the MBG programme.<\/p>\n
\u201cWe hope that the TNI Commander will immediately order this incident\nto be tried in a general court. Why? First, friends, if this continues,\nthe image of our TNI will start to decline again. We already know that\none of the appealing aspects of the TNI over the past 20 years is that\ntheir trust levels have always been high when related to public trust\nlevels, always. Yes, KPK, TNI, President, those three always have high\ntrust levels. But if this continues repeatedly, yes, it will crumble,\u201d\nRay explained.<\/p>\n
Meanwhile, military and geopolitical observer Connie Rahakundini\nBakrie highlighted that strategic intelligence should not only serve as\na tool for national defence but also function as a guardian of democracy\nand human rights (HAM). However, according to her, when coordination is\nweak, institutions are not transparent, and human rights protection is\nignored, intelligence can potentially become a threat to the people.<\/p>\n
