        "content": "<p>The final report was submitted by the Commission for the Acceleration\nof Polri Reform to Prabowo at Merdeka Palace, Jakarta, on Tuesday\n(5\/5\/2026). Jimly Asshiddiqie, as the team chairman, handed it over\ndirectly to Prabowo.<\/p>\n<p>In addition to Jimly, the submission was attended by other commission\nmembers, including Coordinating Minister for Law, Human Rights, and\nImmigration Yusril Ihza Mahendra and his deputy Otto Hasibuan, Minister\nof Law Supratman Andi Agtas, National Police Chief General Listyo Sigit\nPrabowo, President\u2019s Special Advisor on Security and Public Order Ahmad\nDofiri, former Coordinating Minister for Political, Legal, and Security\nAffairs Mahfud MD, and former National Police Chief Idham Azis.<\/p>\n<p>Since its establishment on 7 November 2025, Jimly and all commission\nmembers successfully completed the formulation of police reform policies\nover three months. They held various meetings with stakeholders,\nincluding state institutions, civil society organisations, and internal\npolice entities, as well as visits to several regions to gather public\naspirations.<\/p>\n<p>The results of this work were compiled into 10 report books\ncontaining six comprehensive reform policy recommendations. These\nrecommendations include proposals for revising the Polri Law and\ndrafting derivative regulations to support reform implementation.<\/p>\n<p>\u201cWe reported earlier 10 books concerning the overall policy reform\nand policy alternatives to be implemented by the government or\ninternally by Polri,\u201d said Jimly after submitting the recommendations to\nPrabowo at Merdeka Palace, Jakarta, on Tuesday (5\/5\/2026).<\/p>\n<p>Additionally, the commission proposed an internal reform agenda that\nincludes changes to several regulations within Polri. These reforms are\ntargeted to proceed until 2029 as part of the medium-term agenda.<\/p>\n<p>Here are the complete six recommendations submitted by Jimly and\nassociates to Prabowo:<\/p>\n<ol type=\"1\">\n<li>Position of Polri<\/li>\n<\/ol>\n<p>From the aspiration gathering, several inputs highlighted the\nposition of Polri within the state structure, whether it should remain\nunder the President as currently or form a new ministry to oversee Polri\nadministratively. Although this discussion was not primary and the\npercentage was relatively small, the issue attracted public attention,\nnecessitating clarification to avoid counterproductive debates in the\nPolri reform agenda.<\/p>\n<p>Considering the benefits and harms through various experiences and\npractices to date, as well as the Indonesian context (geographical\nconditions and regional and societal characteristics), all KPRP members\nagreed not to propose a new ministry and to maintain Polri\u2019s current\nposition, with the note that the existence of an external overseer,\nnamely the National Police Commission (Kompolnas), must be strengthened\nwith an expanded mandate of authority.<\/p>\n<ol start=\"2\" type=\"1\">\n<li>Strengthening the National Police Commission (Kompolnas)<\/li>\n<\/ol>\n<p>As a consequence of Polri\u2019s position under and directly accountable\nto the President, this must be balanced by strengthening Kompolnas as an\nindependent institution to ensure that Polri carries out its main\nduties, functions, and authorities effectively and efficiently, in line\nwith legal provisions and public expectations.<\/p>\n<p>The strengthening of Kompolnas is intended so that in carrying out\nits duties, it is not limited to providing strategic advice on Polri\nadministration and input on the dismissal and appointment of the\nNational Police Chief, but also conducts oversight on governance in the\nareas of Polri development and operations, as well as investigations\ninto the enforcement of the Polri professional code of ethics.<\/p>\n<p>Therefore, Kompolnas must undergo fundamental improvements, including\nits position, membership composition, appointment mechanisms, duties and\nauthorities, and budget management. This positions Kompolnas as a fully\nindependent institution that performs a \u201ccheck and balances\u201d function\nagainst Polri with binding decision-making authority.<\/p>\n<ol start=\"3\" type=\"1\">\n<li>Appointment of the National Police Chief<\/li>\n<\/ol>\n<p>The mechanism for appointing the National Police Chief through DPR\napproval has been noted with several inputs suspecting it as an entry\npoint for politicisation in the practice of Polri duties. On the other\nhand, the DPR\u2019s oversight function and sharing the responsibility burden\nbetween the President and DPR in appointing the National Police Chief\nprovide relevant reasons why the mechanism must go through DPR\napproval.<\/p>\n<p>All commission members provided balanced opinions because both sides\nhave strong arguments, considering the advantages and disadvantages.<\/p>\n<p>Therefore, the review between the two is worthy of consideration by\nMr President to determine the appropriate choice with the arguments\nmentioned.<\/p>\n<ol start=\"4\" type=\"1\">\n<li>Assignment of Polri Members Outside the Police<\/li>\n<\/ol>\n<p>Following the issuance of Constitutional Court Decision\nNo.\u00a0114\/PUU-XXIII\/2025 dated 13 November 2025 and Constitutional Court\nDecision No.\u00a0223\/PUU-XXII\/2025 dated 19 January 2026, controversies and\ndebates have arisen regarding the assignment of active Polri members to\npositions outside the police. This impacts the legal and administrative\npositions as well as the validity of decisions by officials falling\nunder those MK decisions.<\/p>\n<p>The impact of this issue affects not only the Polri institution but\nalso other ministries\/institutions with active Polri assignments.\nTherefore, there needs to be clarification and regulation that\nlimitatively specifies in the Law or its derivatives in Government\nRegulations which ministries\/institutions can be occupied by Polri\nmembers for positions outside the police.<\/p>\n<ol start=\"5\" type=\"1\">\n<li>Institutional Aspects and Managerial Aspects<\/li>\n<\/ol>\n<p>In addition to the four main focuses that form the substance of Polri\nreform discussions, the KPRP also recommends substantive matters\nregarding the organisation of Polri\u2019s main duties and functions that\nalign with the principles of good bureaucracy governance \u201cgood\ngovernance and clean government\u201d as outlined in institutional and\nmanagerial aspects.<\/p>\n<p>Institutional Aspects<\/p>",
