200 residents to sue Humpuss Intermoda<\/p>\n
JAKARTA (JP): Some 200 residents from Central and East Java
\nintend to sue publicly listed Humpuss Intermoda Transportasi for
\nallegedly misusing their names for the interests of the company's
\ncontrolling shareholder, former president Soeharto's youngest son
\nHutomo \"Tommy\" Mandala Putra.<\/p>\n
Koesnadi W. Notonegoro, the lawyer representing the residents,
\ntold reporters here on Sunday that he would soon file a lawsuit
\nat a district court in Jakarta after failing to reach an out-of
\ncourt settlement with Humpuss Intermoda.<\/p>\n
Koesnadi said the case surfaced after about 200 residents in
\nSragen in Central Java and Jember, Mojokerto and Sidoardjo in
\nEast Java received dividend payment invoices totaling Rp 750
\nmillion (US$100,000) from Humpuss Intermoda on June 25.<\/p>\n
\"The notification on the dividend payment names each recipient
\nstipulated in the invoice that he or she is entitled to a cash
\npayment commensurate with the sum written on the invoice at
\nappointed branches of state Bank Negara Indonesia 46 (BNI),\"
\nKoesnadi recounted.<\/p>\n
But when the recipients called at the designated BNI branches
\nthey were told the payment invoices were invalid and were
\nadministratively incorrect.<\/p>\n
Humpuss Intermoda is an international sea carrier of crude
\noil, liquefied natural gas and petrochemicals. Most of its
\nbusiness is derived from state-owned Pertamina oil and natural
\ngas company.<\/p>\n
\"On July 13, each of the 200 residents received another letter
\nfrom Humpuss Intermoda asking them return the dividend payment
\ninvoices because there had been an administrative mistake,\"
\nKoesnadi was quoted by Antara as saying.<\/p>\n
The lawyer said that upon investigating, he found that Humpuss
\nIntermoda seemed to have misused the names of the residents,
\nmostly farmers and laborers, for concealing the true size of
\nTommy's share in the company.<\/p>\n
\"Tommy misused their names for nominee shareholders apparently
\nto circumvent the rule on the minimum number of individual
\nshareholders in a public company,\" Koesnadi said.<\/p>\n
Tommy's Humpuss officially owns 83.55 percent of the company.<\/p>\n
According to Koesnadi, Tommy got the names of the people with
\nassistance from a mutual fund management company which somehow
\nsucceeded in collecting photo copies of their identity cards.<\/p>\n
He said he had met several times with Humpuss Intermoda's
\nlegal advisor Setiono Winardi to negotiate an out-court-
\nsettlement of the affair.<\/p>\n
\"My clients are willing to return the dividend payment
\ninvoices and forget the whole thing in return for some
\ncompensation for illegally using their names in the company's
\nshareholder composition.<\/p>\n
But Setiono declined the offer and insisted that we should
\nsettle the case in court,\" Koesnadi added.<\/p>\n
The case has also caused trouble for Bank BNI, he said,
\nclaiming that several employees of the BNI Jember branch had been
\nattacked by people.<\/p>\n
Humpuss Intermoda president Subroto Purwosutarto could not
\nimmediately be reached for comment.<\/p>",
