13-year prison term for sergeant's killers<\/p>\n
JAKARTA (JP): The East Jakarta district court Saturday
\nsentenced Arnold Mamusung and Boy Herowantana to 13 years
\nimprisonment each for killing Police Sgt. Bambang Sumarno in
\nAugust last year.<\/p>\n
\"What made your action unpardonable is that what you have done
\nis very inhumane, and that the victim was on duty at the time of
\nthe murder,\" Presiding Judge Achmad Husin said, stressing that
\nthe defendants had committed the action consciously.<\/p>\n
The judge took into consideration the defendants' good conduct
\nduring the trial and the facts they had not been jailed
\npreviously and are still young.<\/p>\n
Both Arnold and Boy bent their heads as the presiding judge
\nbegan to read the verdict.<\/p>\n
The defendants sat upright only after the judge told them they
\nwould have to do so before the sentence was pronounced.<\/p>\n
Prosecutor I Made A. Ardjana had previously demanded the court
\nsentence Arnold, alias Nano, to a 17-year prison term and Boy to
\n18 years. Boy's offense was considered greater because he had
\ntaken the police officers' gun from him.<\/p>\n
The sentences are three years lower than that passed down by
\nthe same court to Iman Alamin, who was tried separately, and
\nsentenced to 16 years in jail for his role in the murder and the
\ntheft of the victim's gun along with its ammunition.<\/p>\n
Last Aug. 26, Sgt. Bambang was killed by the three men in an
\nempty house at Jl. Kayu Putih Tengah II-D No. 2, Central Jakarta.
\nThe house belongs to Alamin's parents.<\/p>\n
According to the verdict, the three then took the sergeant's
\nbody to a rubber plantation in Cianjur, West Java, and set fire
\nto it to conceal the deceased's identity.<\/p>\n
The prosecutor said the defendants' motive for the killing was
\nto seize Sgt. Bambang's gun, but the court exonerated the three
\nfrom those charges because there was not enough evidence to
\nsupport the assertion.<\/p>\n
At the previous sessions, all the convicts denied written
\ntestimonies they made before the police saying that they had been
\nbeaten before the questioning to force their confessions. Police
\ndenied they tortured the defendants.<\/p>\n
To support their torture claim, the three presented before
\nthe court pictures of their swollen faces published by a Jakarta-
\nbased newspaper.<\/p>\n
After announcing the sentence, the presiding judge asked if
\nthe prosecutor or the defendants planned to appeal to the high
\ncourt.<\/p>\n
Both Boy's and Nano lawyer said they were still considering
\nwhether to appeal.<\/p>\n
\"I should consult with my client first before I make any
\ndecision on this matter,\" Boy's lawyer later told the Jakarta
\nPost<\/p>\n
Prosecutor Ardjana was also considering appealing the
\nsentences, which he felt should have been harsher. (11)<\/p>",
