Govt completes
\ndraft revision of
\nantiterror law<\/p>\n
The government has completed the draft revision to the much-
\ncriticized Antiterrorism Law No. 15\/2003 that will grant more
\npower to security authorities in deterring acts of terrorism.<\/p>\n
Abdul Gani, the director general of legislation at the
\nMinistry of Justice and Human Rights, said the revision was aimed
\nat giving security authorities more rooms to combat terrorism.<\/p>\n
The draft will target not only perpetrators of acts of terrors
\nbut also those who are indirectly involved in the extradordinary
\ncrime or who assist the perpetrators, he said.<\/p>\n
Article 9 of the draft stipulates that people who are selling
\nexplosive materials can be charged under the antiterrorism law if
\nthe materials can endager human life and the environment or if
\nthe materials are proven to have been used in terrorist
\nactivities.<\/p>\n
Human rights activists have opposed the antiterrorism law,
\nsaying it opens the door wide for rights abuses, particularly an
\narticle that stipulates intelligence reports are enough basis to
\nprosecute a person for an alleged act of terrorism.<\/p>\n
Under the Criminal Code preliminary evidence is required to
\nprosecute an individual.<\/p>\n
Taking a deaf ear to human rights campaigners' demand, the
\ndraft revision of the antiterrorism law says intelligence
\ninformation is justified to start a formal investigation upon
\napproval from district court judges, In comparison, the law
\nrequires the consent of the head of a district court.<\/p>\n
\"We consider winning approval from the head of courts is not
\neasy, there fore we decided that every judges have authorities to
\napprove the intelligence report after held a close-door
\nexamination for about three days,\" Abdul said, adding that public
\nshould have no access to the examination process for grounds that
\n\"exposing it would only give a room for suspected terrorists to
\nflee.\"<\/p>\n
The Article 31 of the draft also stipulates that security
\nauthorities -- after securing an approval from the district
\ncourts' judges -- have authorities to intercept telephone or to
\ninspect mails or correspondence which were believed to accomodate
\npeople in plotting such terror acts.<\/p>\n
Compared to the Law No. 15\/2003 which allows the authorities
\nto detain people for seven days in the absence of strong legal
\nevidence that the person may have committed terrorist acts, the
\nrevision draft has even extend the term for a preliminary
\ninvestigation purposes up to 30 days.<\/p>\n
The draft, nevertheless, lessen the detained term for a
\nsuspect to face further investigation from six months to only 120
\ndays, or about 4 months.<\/p>\n
The revision also propose an article which carry a 12-year in
\njail sentence against people who fail to inform security
\nauthorities over the act of terrorist or to assist such terror
\nacts from taking place.<\/p>\n
The proposed Article 13 line (b) even regulates that people
\ncan be charge of committing terrorist if they wear clothes or use
\ncertain organization's symbols to create terror among public.<\/p>\n
But Abdul immediately said that such proposed Article \"will be
\nscrapped.\"<\/p>\n
\"We will soon propose the draft to the President and
\ndeliberate it with the lawmakers,\" Abdul said.<\/p>\n

Church bomber gets 12 years in jail<\/p>\n
The Central Jakarta District Court sentenced a Malaysian on
\nThursday to 12 years in jail for his involvement in the July 22,
\n2001, bombing of Santa Anna Catholic Church, East Jakarta, that
\nkilled one and injured 67 other congregants during a full morning
\nservice.<\/p>\n
Judges found Nur Misuari, alias Nurdin, 25, guilty of illegal
\nexplosives possession.<\/p>\n
\"The court is convinced that the defendant possessed,
\nassembled, carried and used the explosives in violation of the
\n1951 Emergency Law,\" presiding judge Zainal Abidin Sangadji read
\nthe verdict.<\/p>\n
Both the prosecution and defense said they would appeal.<\/p>\n
The sentence, which is retroactive and will be reduced by the
\ntime Misuari has spent in detention since April 22, 2003, is
\nthree years more lenient than the prosecution's request.<\/p>\n
Misuari was charged with mixing Research Development Formula
\nExplosive (RDX) and trinitrotoluene (TNT) to compose a bomb and
\nwith targeting the church on Jl. Arafuru, Pondok Bambu district.
\nHis accomplice, Asep, alias Abdullah, planted the bomb.<\/p>\n
In his defense, Misuari pleaded innocent and said he had only
\nobeyed orders to take Asep, who is still at large, by motorcycle
\nto the church. He said Asep was carrying a black plastic bag.<\/p>\n
Dozens of victims were severely injured and survived the blast
\nonly after undergoing numerous operations and intensive care
\ntreatment. Some sustained permanent injuries, as doctors had to
\namputate limbs damaged in the blast.<\/p>\n
A number of victims were blinded and lost their hearing in the
\nblast.<\/p>\n
In the indictment, the prosecution recounted that the church
\nbombing followed the nationwide 2000 Christmas Eve bombings
\ninvolving Imam Samudra, the mastermind of the Oct. 12, 2002, Bali
\nbombing.<\/p>\n
Samudra, a member of the regional terrorist network Jamaah
\nIslamiyah, was sentenced to death by the Denpasar District Court
\nin September 2003. The Bali bombing killed 202 people, mostly
\nforeign holidaymakers.<\/p>\n
The series of bombings are believed to be retaliation for the
\ndeaths of Muslims in the bloody sectarian conflict in Maluku.<\/p>\n

The Indonesian Broadcasting Commission (KPI) and the General
\nElections Commission jointly issued on Wednesday a join
\nregulation on electoral campaign in electronic media, banning
\npolitical parties or regional representative aspirants from
\nfinancing informative , education and entertainment program from
\nelectronic media.
\nThe issuance of the join agreement was attended by KPI
\nchairman Victor Menayang, KPU chairman Nazaruddin Sjamsuddin
\naccompanied by KPI and KPU members.
\nThe join regulation stipulated that every electronic
\nmedia must not be pro-one political party or regional
\nrepresentatives aspirant in their informative or news program.
\nBut an electronic media could provide specific news
\nprogram for political parties or regional representives
\ncandidates, it addd.
\nIn educational program particularly polling, electronic
\nmedia is obliged to explain and air methodology of the polling,
\nthe responsible institutions, sample, questionaires and the
\nperiod of the polling, the regulation stated.
\nThe educational program of electronic media included an
\ninteractive dialog, monolog, polling, and debate, it added.
\nIn entertainment program, electronic media is prohibited
\nfrom having agreement with political parties or regional
\nrepresentative program to produce entertainment program and
\nallocation blocking time of entertainment program, the regulation
\nstated.
\nIn advertisement, a political party or regional
\nrepresentative aspirant is allowed to advertise their campaign at
\na maximum 10 spots per day per television stations with a
\nduration of 30 seconds per spot, it said.
\nIt also stipulated an electoral campaign time in radio
\nfor one political party or regional representative aspirant was
\nalloted at a maximum 10 spots per day per radio with a duration
\nof 60 seconds per spot.
\nBesides, every electronic media must allot free campaign
\nfor political parties and regional representatives candidates
\nonce in the campaign period of between March 11 and April 1, the
\nregulation said.
\nIt also said that every electronic media was prohibited
\nfrom selling unused spot allocated to a political party or
\nregional representatives aspirant to other political parties or
\nregional representatives candidates.
\nPolitical parties or regional representatives aspirants
\nare obliged to pay in advance the cost of advertisement, it
\nadded.
\nAccording to the regulation, political parties or
\nregional representatives aspirants that violated the join
\nregulation will be given administrative punishment referring to
\nthe related law.
\nElectronic media which breached the join regulation will
\nalso be punished based on Law No 32 on broadcasting, the
\nregulation said.
\nVictor has said that, according to the broadcasting law,
\nany electronic media could be given a warning or banned to
\nbroadcast if they violated the law.<\/p>\n
\"This regulation aimed at regulating electoral campaign
\nfrom political parties or regional representatives candidates and
\nprotect the interest of electronic media,\" Victor said.
\nA political analyst Rizal Mallarangeng has said that
\nelectronic media would obtain huge money during the electoral
\ncampaign as political parties and regional representatives
\ncandidates would use them to effectively reach people in the
\ncountry.
\nHe said that electronic media particularly TV stations
\nwould get at least 40 percent of the total campaign fund of
\npolitical parties or regional representatives candidates.
\nA total of 24 political parties and over 900 regional
\nrepresentatives aspirant will contest the 2004 elections.

Massive floods leave much of Indramayu under water<\/p>\n
Massive floods submerged a greater area of Indramayu regency on
\nThursday, inundating paddy fields and residential houses.<\/p>\n
Indramayu regent Irianto M.S. Syaifuddin said that, as of
\nThursday, 106 subdistricts in the regency had been affected, far
\nmore than the day before, when 62 subdistricts had been affected
\nby floods.<\/p>\n
He added that the area of flooded paddy fields had doubled.<\/p>\n
\"The floods washed over 23,000 hectares of paddy fields today,
\na sharp increase from the day before, when 10,000 hectares of
\npaddy fields were submerged by floods,\" Irianto said.<\/p>\n
He added that the 23,000 hectares amounted to 22 percent of
\nthe total 103,000 hectares of paddy fields in Indramayu regency.<\/p>\n
Indramayu is one of the prominent rice producers of Java
\nisland.<\/p>\n
Besides inundating paddy fields, the flooding also obstructed
\nmain roads here, connecting Losarang with Cikedung district and
\nKandanghaur with Losarang district.<\/p>\n
The Losarang to Cikedung route was obstructed after water
\ninundated Pegagan bridge in the Losarang district. Cipanas river
\nhad also overflowed, so that water inundated almost two
\nkilometers of the road.<\/p>\n
Meanwhile, the nearby Kandanghaur to Losarang route was
\nflooded when a bridge in Cilet subdistrict, Kandanghaur, was
\ninundated.<\/p>\n
The water levels on the roads of those two routes was 30 to 50
\ncentimeters deep.<\/p>\n
The northern coastal highway of Java island was also flooded.
\nThis busy road connects Jakarta with other provinces on the
\nisland.<\/p>\n
Pools of water 10 to 50 centimeters deep could be found along
\nthe highway in Eretan Kulon, Eretan Wetan, Karangsinom,
\nKaranganyar and Kiajaran Wetan subdistricts.<\/p>\n
It is feared that the highway could also be impassable if
\ntorrential rains continued to pound the area.<\/p>\n
Indramayu Police chief Adj. Sr. Comr. Johnny Suroto said that
\nthe police had prepared an alternative route.<\/p>\n
\"If the highway is obstructed, we will direct the flow of cars
\nto the Cikamurang to Subang route, which will allow travellers to
\nreach other provinces of Java island, such as West Java and
\nCentral Java,\" said Johnny.<\/p>\n
Meanwhile, 500 residents of Kandanghaur district, the area
\nwhich has been hardest hit by the flooding, sought refuge in
\nsafer areas on Thursday, after their homes were flooded.<\/p>\n
\"My home is inundated, we can no longer stay there,\" said
\nTarina, 40, who has been living in a tent for four days with her
\nfamily.<\/p>\n
The evacuees complained that the government had ignored their
\nsituation.<\/p>\n
As their money was running low, the evacuees -- who are living
\nin tents along the highway on the north coast of Java -- began to
\nask passersby for money.<\/p>\n
\"We can't raise money, because we live in tents. The
\ngovernment has yet to disburse aid,\" he said.<\/p>\n

Tunnel of love for Swedish frogs<\/p>\n
STOCKHOLM: Love-hungry frogs in a southwestern Swedish town
\nrisk their lives daily crossing a busy road to reach their mating
\npond, but concerned officials are now building a special tunnel
\nfor them, media reported on Thursday.<\/p>\n
The 150-meter tunnel under road 161 outside Uddevalla is also
\nexpected to be used by water salamanders who mate in the
\nJaernkleve pond, Swedish news agency TT said.<\/p>\n
Until now, the frogs and salamanders have been guided to
\nplastic buckets along the roadside, where officials have
\ncollected the buckets several times a day and carried them across
\nthe road so they could either mate or return home.<\/p>\n
But the love lineup proved not so popular, neither among the
\nfrogs nor their carers, and so the Swedish National Road
\nAdministration agreed to the tunnel.<\/p>\n
The agency previously built a similar tunnel for frogs near
\nGothenburg, where an increased number of successful matings have
