TEMPO Interactive, Jakarta: The Business Competition Supervisory Commission have regretted President Susilo Bambang Yudhoyono's meeting with Chief Executive Officer of Carrefour Group Lars Olofsson in Paris last week amid the legal proceedings on monopoly faced by the retailer's operation in Indonesia.

Head of the commission Benny Pasaribu said on Monday “The case has been decided by the business competition commission and now is being examined by the district court. It should went through the court completely uninterrupted.”

The commission ruled on early last month that Carrefour takeover on Alfa Retailindo have violated two articles in the Law No.5 of 1999 on Monopoly and Unfair Business Competition, which dictates Carrefour to release 75 percent of its stake in Alfa within one year after the decision and pay Rp25 billion fine to the government.

He said the president should have not met with Carrefour as the meeting could be seen as dismissing the commission's ruling. The commission will send a notice on its decision to the president and the progress report of the case, as Carrefour is appealing against the commission's ruling.

Carrefour Did Not Lobby Yudhoyono’

President Susilo Bambang Yudhoyono did not hold a special meeting with Carrefour’s chief executive during his visit to France last week, a presidential spokesman said on Tuesday.

However, the Carrefour chief executive, Lars Olofsson, was among those in attendance at a meeting between the president and the French Chamber of Commerce, the spokesman said.

“The truth is that the president held a meeting with the French Chamber of Commerce and Carrefour’s chief executive attended the forum,” Julian Aldrin Pasha told the Jakarta Globe.

“The meeting, in Paris on Monday, December 14, was attended by local businessmen who are members of the chamber, not just the Carrefour executive.”

Irawan Kadarman, director of corporate affairs at PT Carrefour Indonesia, last week claimed the Carrefour chief executive met Yudhoyono to discuss the Business Competition Supervisory Commission’s (KPPU) ruling that Carrefour Indonesia had violated antimonopoly laws.

“They discussed the KPPU November ruling that Carrefour had breached antimonopoly laws,” Irawan said.

Julian said Olofsson asked Yudhoyono about the KPPU ruling during a question-and-answer session but did not specifically lobby the president on the issue. “The president did not give any comment or answer to his question,” he added.

KPPU chairman Benny Pasaribu expressed concern about Yudhoyono’s meeting with Olofsson, saying he considered the meeting improper because Carrefour was still implicated in a monopoly case.

On Nov. 3, the KPPU ruled that Carrefour’s Indonesian subsidiary was guilty of breaching antimonopoly laws by dominating the wholesale supplier market and forcing unfair trading terms on its suppliers following its acquisition of PT Alfa Retailindo in 2008.

The KPPU fined Carrefour Rp 25 billion ($2.6 million) and ordered it to sell its stake in Alfa Retailindo.

Carrefour has strongly rejected the KPPU’s ruling, arguing that its methodology was flawed.

It has appealed the ruling to the South Jakarta District Court.
